TERMS OF SERVICE

1. Overview

These Terms of Service (“Terms”) govern all orders and use of our website www.the-storywall.com (“Site”) operated by The Story Wall, based in Munich, Germany (“we”, “us”, “our”). By purchasing through our Site, you agree to be bound by these Terms. Please read them carefully before placing any order.

We reserve the right to modify these Terms at any time. The version effective at the date of your order applies to that order.

2. Definitions

  • Customer / You: Any person purchasing or using our products.
  • Goods / Products: Physical printed artworks, certificates, and accessories offered on our Site.
  • Photographer / Seller: Independent contributor providing photographs, stories, or visual content to The Story Wall.
  • Made-to-Order: Items produced individually after your purchase confirmation.

3. Scope & Contract Formation

A purchase contract is concluded once you complete checkout and we send a confirmation email. We may refuse or cancel an order if an error in price, stock availability, or image rights occurs.

All prices include VAT where applicable. Customs duties and import taxes (outside the EU) are the buyer’s responsibility.

4. Payment

Full payment must be received before production starts. Payments are processed securely through our integrated providers (e.g., Shopify Payments, PayPal). If a payment fails, the order will not proceed.

5. Production & Shipping

Each print is made-to-order and usually produced within the time indicated on the product page. Delivery times are estimates and may vary due to logistics, customs, or unforeseen events.

Risk passes to you once the item is handed over to the carrier. We are not liable for delays or loss caused by customs, strikes, or transport issues beyond our control (“Force Majeure”).

Shipping address accuracy is the buyer’s responsibility. Packages returned due to incorrect addresses or unclaimed parcels will not be refunded.

6. Product Representation & Quality

Images shown on the Site are as accurate as possible; however, due to differences in screens, lighting, and rendering, the final printed product may vary slightly in color, contrast, or finish.
Minor differences or imperfections in shade, tone, or texture do not constitute defects, and no refunds or returns will be accepted on this basis.

Each print meets our museum-grade quality standards, yet if items arrive with minor surface imperfections (small dents, scratches, or marks not affecting overall appearance), refunds or replacements will not be issued.

7. Damages & Returns

Because our products are custom-made, we cannot accept general returns or exchanges.

If your order arrives significantly damaged (e.g., torn print, broken packaging affecting the product), contact us within 7 days of delivery with clear photos at [email protected].
We will assess and, if approved, arrange a replacement or refund.

If a refund is agreed, label will be supplied by TSW and customer must send the goods to our studio in Munich, Germany. No in-person returns or drop-offs are accepted.

8. Photographer Responsibility & Intellectual Property

All photographers and content contributors confirm that the images they submit:
(a) are their own original works, and
(b) do not infringe any third-party rights.

We are not responsible for copyright violations, plagiarism, or duplicated content submitted by photographers.
If an infringement or duplicate sale on another platform is reported and verified, we will:

  • immediately remove the affected work,
  • suspend or permanently remove the photographer’s account, and
  • reserve the right to pursue legal action or claim damages from the contributor.

All intellectual property (images, text, branding, certificates, website design) remains the exclusive property of The Story Wall and its photographers.
Purchasing a print does not grant reproduction, digital use, resale, or licensing rights. Private decorative use only.

9. Customer Conduct

You agree not to misuse our Site or attempt to reverse-engineer, copy, or commercially exploit our materials, trademarks, or content.

10. Limitation of Liability

We shall not be liable for indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the amount paid for the specific product concerned.
Nothing in these Terms excludes liability for gross negligence, intent, or any mandatory consumer rights under German law.

11. Data Protection & Privacy (GDPR / ePrivacy)

We comply with the EU General Data Protection Regulation (GDPR) and ePrivacy Directive.

By purchasing or using our Site, you consent to the collection and processing of your personal data (such as name, address, payment details, and email) for the purposes of:

  • processing and fulfilling your order,
  • communicating about delivery or support,
  • improving our services and product experience,
  • complying with legal obligations (invoicing, record-keeping).

Your data will not be sold or shared except with trusted service providers (e.g., payment gateways, logistics companies) who process it on our behalf under strict data-protection terms.

12. Force Majeure

We are not responsible for delays or non-performance resulting from events outside our reasonable control (natural disasters, strikes, customs delays, transport failures, or digital service interruptions).

13. Termination

We may suspend or terminate access to our Site or services if you breach these Terms or misuse intellectual property.

14. Governing Law & Dispute Resolution

These Terms are governed by German law. Jurisdiction is Munich, Germany.
Consumers within the EU may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

15. Severability & Entire Agreement

If any clause of these Terms is found invalid, the remaining provisions remain fully effective.
These Terms constitute the entire agreement between you and The Story Wall regarding the purchase of our products.
