The Story Wall — Seller Terms & Conditions

1. Introduction

Welcome to The Story Wall (“TSW,” “we,” “our,” or “us”).
These Terms and Conditions govern participation in The Story Wall’s Artist and Seller Program (“Program”), which enables photographers and storytellers to submit, license, and sell their work through our curated platform.
By submitting your stories or images to TSW, you (“Artist,” “Seller,” or “you”) agree to the terms outlined below.

2. Eligibility

To participate, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction).
  • Be the original creator and copyright owner of all submitted works.
  • Have the legal right to grant TSW limited usage rights for marketing and sales.
  • Agree to all clauses within these Terms and Conditions.

We reserve the right to decline applications at our sole discretion.

3. Submission Process

Artists may submit up to 10 low-resolution images for review using the official submission form.
Each submission must include:

  • A short written story or description (location, year, context, or emotion behind the image).
  • Confirmation that the submitted image is your own work.
  • Agreement to these Terms and Conditions.

Submissions are reviewed by our curation team. Approval is not guaranteed, and decisions are final.

4. Acceptance & Onboarding

If selected, TSW will contact you to:

  • Request high-resolution files of approved works.
  • Sign a formal Artist Agreement specifying edition details, pricing, and revenue share.
  • Approve your story, provenance card, and product page before public release.

Once onboarded, your story becomes part of The Story Wall’s curated collection.

5. Rights & Ownership

  • You retain full copyright ownership of all images you submit.
  • By joining the Program, you grant TSW a non-exclusive, worldwide license to reproduce, market, and sell prints of the approved editions.
  • TSW may use your images, name, and biography for marketing, editorial, and promotional purposes related to The Story Wall only.
  • This license does not allow TSW to sell digital copies or sublicensed materials outside of print editions.

6. Editions & Exclusivity

Each accepted work is categorized as one of the following:

  • Limited Edition (50 prints) – Numbered and verified with a provenance label and certificate.
  • Exclusive Edition (1/1) – Single collector print, signed by the artist or studio.
  • Open Edition – Optional category for curated ongoing prints.

Exclusive and Limited Edition stories must remain exclusive to TSW for the full lifetime of the edition.

7. Pricing & Commissions

  • Retail prices are jointly defined by the artist and TSW’s curatorial team.
  • Artist commissions range from 15% to 35% of the net sale price (excluding taxes, shipping, and processing fees).
  • Payments are made automatically once per month via the payment method on file.
  • A transparent dashboard will display edition sales, stock, and payout history.

8. Affiliate Program

Artists may opt into TSW’s affiliate program and receive an additional 5% commission on referred sales.
Affiliate links are provided individually through the dashboard. Misuse (e.g., self-referrals or false promotion) will result in suspension.

9. Production & Fulfillment

All products are printed, checked, and packaged in TSW’s Munich studio.
We ensure museum-grade quality standards, careful handling, and authenticity verification for each collector’s order.
Artists are not responsible for any printing, shipping, or customer service processes.

10. Payouts & Taxes

  • Payouts are processed monthly for completed sales (after delivery confirmation).
  • Artists are responsible for any applicable tax reporting in their home country.
  • TSW will provide basic payout documentation upon request for accounting purposes.

11. Marketing & Promotion

TSW may promote your stories via:

  • Social media, newsletters, and press features.
  • Collector outreach and gallery partnerships.
  • Website stories and artist spotlight features.

You consent to TSW using your provided materials (bio, portraits, quotes, and images) for promotional content linked to your work.

12. Removal or Termination

Either party may terminate the collaboration with 30 days’ written notice.

  • All pending payouts will still be completed.
  • Limited and Exclusive Editions that have been sold remain permanently part of the collector network and may not be withdrawn retroactively.
  • TSW reserves the right to remove any work or artist for violation of these terms, plagiarism, or reputational concerns.

13. Limitation of Liability

TSW is not liable for indirect or consequential losses arising from participation in the Program.
Our total liability shall not exceed the total commissions paid to the artist during the 12 months preceding any claim.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Germany, and any disputes shall be handled by the competent courts of Munich, Germany.

15. Updates to Terms

TSW may update these Terms periodically to reflect operational or legal changes.
Artists will be notified of any significant updates before they take effect.

17. Content Policy & Brand Integrity

To preserve The Story Wall’s artistic vision, authenticity, and legal integrity, all submitted works and collaborations are bound by the following rules:

1.Brand Alignment:
Once accepted, The Story Wall retains full creative control over how each story is presented, including product titles, descriptive text, layout, mockups, marketing materials, and imagery.
Artists may not request edits or alterations to listings, texts, or visuals once the story is published, as all presentation follows The Story Wall’s brand standards and aesthetic direction.

2.Authenticity of Work:

  • We do not accept AI-generated, AI-assisted, or heavily digitally manipulated images that distort the authenticity of the original photograph.
  • All submissions must be genuine photographs captured by the submitting artist.
  • Only minimal adjustments such as color correction, cropping, or exposure balancing are acceptable.

3.Location Requirement:
Each story must include the exact or approximate GPS coordinates or location name where the image was taken. Submissions without valid location data will not be considered.

4.Ownership & Rights:

  • Artists may only submit works they fully own and control, with no third-party restrictions.
  • Works created under employment, agency contracts, or shared copyright ownership cannot be submitted unless all rights are cleared in writing.
  • By submitting, the artist declares full ownership and indemnifies The Story Wall against any disputes or third-party claims.

5.Copyright & Liability:
The Story Wall assumes no liability for copyright infringement or misrepresentation caused by false or misleading submissions.

  • If a legal claim or copyright dispute arises, it will be redirected to the submitting artist, who bears full responsibility for defending and resolving the matter.
  • The artist agrees to fully indemnify The Story Wall from any damages, legal fees, or penalties resulting from such claims.

6.Exclusivity & Consistency:

  • Accepted works must remain exclusive to The Story Wall for the full lifetime of the edition.
  • The same images, or near-identical variations, may not be listed or sold elsewhere, including stock platforms, print-on-demand services, or NFT marketplaces.

7.Moral Rights & Modifications:
The Story Wall respects the moral rights of all artists but reserves the right to:

  • Crop or resize images to fit the platform’s visual standards.
  • Create product mockups and contextual images for marketing and editorial purposes.
  • Add The Story Wall’s branding, logos, or edition marks for authenticity and verification.

8.Removal & Termination:
The Story Wall may suspend or remove any artist’s work or profile if these conditions are breached, including use of AI content, copyright violations, or actions that damage the brand’s integrity.
